What is the warranty repair practice in the EU countries?

I administer through TeamViewer a Toshiba laptop of a friend who lives in Spain. About a month ago, the hard drive in the laptop began to die gradually. One fine day, the laptop did not turn on at all, apparently the contact in the power connector was lost. Since the laptop still had a factory warranty, I suggested that a friend take it in for warranty repair and point out that, among other things, the hard drive was also faulty. Which she did. After 2 weeks, she received a call and was told that she needed to pay 109 euros for the replacement and repair of the top panel of the laptop, allegedly because of its internal break it was impossible to get to the hard drive. Nothing to do, the friend agreed. I asked about replacing the hard drive. They said they would replace it under warranty. A little more than a month passed and the laptop came from repair, a broken top panel was also attached, which has been replaced. What was broken there, I never saw through the Skype video. The first thing I noticed was the SMART of the replaced hard drive. The number of inclusions is 0C - 466, load / unload cycles C1 - 13187, errors under shock loads BF - 102, etc. It is clear that the disk has already worked a lot somewhere. The question is, does replacing a hard drive under warranty in the EU countries allow replacement with a hard drive that is clearly used or is it worth starting to make claims?

Couldn't the factory (at the time of acceptance they said that the laptop would be sent to the Toshiba factory in Europe for repair) reset all the values ​​​​to the right ones, hide unstable sectors and it seems like the hard drive is already different?

I won’t speak for the EU, I will speak for the Swiss: warranty repair of equipment is a scam. They don’t know how to do it normally, crooked-handed engineers apparently sit on a salary cut down to a minimum.
I do not exclude that they did not put in a new part, but a used one (from another laptop), or when sending it, instead of completely turning it off, they put it into hibernation mode.
Dealt with a broken SONY Xperia. At a waterproof phone, the vibration motor began to shorten due to corrosion. We went through the phone, replaced the sensors and boards, while assembling and testing we forgot to test the loud sound, that is, the phone became mute. The second time I passed it - the speaker's paws were not bent in the upper part, the sound disappeared when talking. Well, they sealed it with almost the same tape that was originally.

Continuation of a story.
My friend turned to a computer scientist (as in Spain they call a person working on the repair of computer equipment), whom she knows well. He assured her that in the event of a warranty repair in Spain, they should replace the defective part with a new one, and not with a used one. In this case, the hard drive has clearly been (considering the number of hours of operation according to SMART) in operation for about a year, so there can be no talk of hibernation.
They gave the laptop back to the store, they said at the reception that they had not yet encountered this, but this is just a receptionist who does not understand computer technology at all. Now it must be sent back to the factory with a complaint. So in the EU countries there are fans to throw a client. I'm not sure that this time they will install a new disk, but I will unsubscribe with the results.
