Is there a legal provision that when buying a product (goods) that the product being sold is new?

Is there a legal provision implying when purchasing a product (goods) that the product being sold is new, not used, not restored from used parts and parts, unless this is clearly indicated in the contract / invoice / product passport?
Preferably not based on common sense, but with references to the norms (CC?).
