There are source codes, there are freelance performers with whom we paid and with whom we developed. Everything from page prototypes and editing comments. I talked with the design developer, he generally says that the right belongs to him, and we only have the right to use the design. Performer for a citizen of the Russian Federation.

What court are you talking about? The source code in the layout does not matter at all. A coincidence and nothing more. Design - they will replace the pictures with their own, that's the whole design for you. The logo, your brand, will not be used by anyone.
And in general. You need a full address to file a lawsuit. Hosting will not give it to you. Abuse on the host if you write, so they are on the side (and rightly so). The answer will be to sue, but to whom? You will apply for hosting, then you will receive a counterclaim, and mom, don’t worry, you will pay.
Humble yourself =) In general, take control of the site. You will see on it the placed advertising of Google or Yandex. Turn on the proxy and take revenge =)))

On Russian hostings (and the former CIS) they don’t like to bother with clarifying the rights and other things, if you provide evidence that your site has been working longer and provide a letter from the designer with an example of the source, they will ask for a plagiarizer from their server, usually within seven working days. A year ago, this method worked with a site-copy of the store where I worked.
