How to create an OS based on Windows?

Hello!
Lately I've been reading the news and seeing headlines: "Google and Apple teamed up to create a new Unix OS", "Nokia and Intel teamed up to create Meego OS based on the Linux kernel", "android is one of the best mobile OS based on the Linux kernel", " linux distribution. And why are there no phrases: "Windows distribution", ""many laptop manufacturers are trying to customize Windows", although "many phone manufacturers are trying to customize android for a unique look""?! How can you write your own OS based on the DOS kernel, Windows or Windows OS?! How to install a different graphical shell on Windows?

Linux - open source. Get the source and make your own.
Unix - open source. Get the source and make your own.
Windows is a closed product. Only Microsoft has the sources, and if you find them somewhere and try to use them for your own purposes, it will be a violation of copyright.

Windows is a proprietary system - no one will show you the source codes, and will not give permission to use them in their projects.
