Do freelancers need an IP?

The bottom line is, I passed all the certification for the Bitrix developer, but in order to sell my templates and solutions, you need to open an individual entrepreneur or LLC. I work in a company, and I consider selling solutions as a part-time job. I read that opening an individual entrepreneur is not expensive and taxes are ~ 20,000 rubles per year. But at the same time, the individual entrepreneur risks all his property (If it’s not difficult, explain in what cases). This is the question, is it worth bothering to open your own business? If so, which is better LLC or IP?

First, figure out how much you earn. If you are planning 150-200 thousand rubles a year, you do not need an individual entrepreneur, LLC, or any other legal form. Sell as an individual. Tax officials are not interested in messing around with small things, this is purely from personal experience.
If you still decide to open officially, then IP. This form is much easier to administer. For taxes - you submit an application for a simplified taxation system immediately upon registration, 6% income. This means that you received 1,000 rubles, no matter how much you have in this 1,000 costs, but you must give 60 rubles to the state. This is what you pay to the FTS. Didn't earn anything - the Federal Tax Service has no claims against you (you don't pay anything).
Further PFR. There you pay a fixed price. contribution. To the question of how much: 5994 rubles (minimum wage in your region) * 26% (contribution rate) * 12 months = 18701.28 rubles. According to a similar formula, you count on medicine (compulsory medical insurance fund). There the rate is 5.1%. I’ll make a reservation right away that you pay to the Pension Fund, you always pay, regardless of whether you worked as an individual entrepreneur at all, whether you earned 100 rubles a year or 100 thousand. The amount is about 20 tr. you have to pay them a fee. If you don’t give it back, get ready to communicate with bailiffs, block accounts, arrest a car, etc. The PFR will take your money from you, because they have a deficit of 1 trillion there. rubles and this structure is tearing and throwing everything for every penny. Demands to pay arrears, penalties (if overdue) come regularly. Their last paper killed them at all ... You have a arrears of 8 kopecks, pay ... Paper + paint + envelope are more expensive)))
According to the reports - without employees, you report only to the Federal Tax Service and only about income. The deadline is April 1st. For example, if you issued an IP tomorrow, then you must report your income to the Federal Tax Service before April 1, 2016. I can recommend Elba.Kontur
to help with all organizational and legal matters . The My Business service is still promoting something similar, but I have not used it.

Definitely LLC, especially knowing what kind of "non-biased" judicial system we have in which case.

Taxes will be higher, that's for sure. You risk all your property if the court decides that you owe someone! Estimate the income, if there is a profit, then why not. There are practically no risks in selling your products. Unlike services or if you sell someone else's, there is a risk of being left with a purchased and unsold product / service.

If you are a manufacturer of products - open boldly, pay taxes and sleep peacefully.

Look who your customer is. If it is assumed that individuals will buy templates, then registering an office is at the discretion. If you sell templates to legal entities, then please note that a legal entity will not buy from an individual, because. they need closing official papers for any expense.

For small sales I use the services of a third party SP or LLC, they charge 6 percent for taxes and 4 percent for services. To open it yourself with small earnings of a couple of hundred thousand a year is crap, which will not pay for itself.

According to my last communication with Bitrix support, partner status and certification as a developer do not give anything without concluding a paper contract with them as a legal entity. Without this, you will not have any financial relations such as selling modules in the marketplace and selling licenses to customers.
If you want to open an IP only for cooperation with Bitrix, then for a start I advise you to calculate how much money it will bring you.
As an individual entrepreneur, you pay approximately 20-25 thousand taxes to the Pension Fund, etc. + 6% of everything you earn + 1% of income over 300 thousand per year.
Accordingly, in order to be in the black, you must be guaranteed to earn at least 20 thousand per month as an individual entrepreneur. If you are sure that the sale of your solutions will bring you so much, then you can get confused, if you are not sure, then there is a risk of getting a bunch of hemorrhoids and life experience instead of money and in a year cursing to close the IP.
Maybe I'm wrong, but it's worth opening an IP with a stable income of 100, and preferably from 200 thousand per month, otherwise it's not worth it.

You can open an individual entrepreneur almost free of charge, but you will be tormented by the thresholds, it is easier to entrust this service. Since you have 6%, which means that you don’t really need documents from you for customers, you don’t participate in the VAT refund chain. Therefore, there are almost no problems with documents. Sign the contract and work forward, but the contract can be oral. Ideally, you should have only an act of work done with the signature of the customer. All the money on the current account from this amount you pay taxes. Retirement money can be deducted from taxes. As a rule, banks have a large commission for cashing out from the company's current account, so you can start a card in another bank and send the client to yourself through the bank. There will be a seal, such a thing is not particularly necessary, but you can write out a power of attorney, for example. And work to recapture the pension fund and break even.
