What is the legal liability of a missing freelancer?

The bottom line is this - the project executor disappeared, with whom they worked in the gray without contracts and with the transfer of payment to a card and an authorized wallet. From confirmations of work - correspondence.
I don’t plan to look for him with dogs - I have been in this area for a long time and, in principle, it’s my own fault that I turned to him. But I became interested, as in theory, he will be punished by law. Googled - it seems to be Art. 159 of the Criminal Code and art. 171 of the Criminal Code - fraud and illegal business. The total damage is in the region of 70k, which means that for 159 - a fine, for 171 - nothing (there is no major damage, because less than 250k).
A question for local lawyers - am I right about the articles, how do such cases usually go and what's what in general? Google didn't really help, or I don't know how to find it. Thanks in advance!
UPD:he doesn’t know about knowing - the moment that the money was transferred to his card or a confirmed account is not taken into account?
