The distribution of "adult films" is prohibited, but how can you tell if a person is watching a video on a site or uploading it to a hosting?

If I register a domain and hosting and insert a similar video (for example, through html5) on the page. This is considered a site and there is a video prohibited by law. But how to understand whether a person uploaded a video to a hosting or just visited the site at the address and looked?
The same goes for any other illegal activity. How to prove that it was I who uploaded (that this is my hosting account, etc.) something illegal to the server (site) or I just went to the site as a visitor? What is the difference between these people in terms of the network (technically)?
