Responsibility of the incoming admin

Good day, Khabrovites.
Based on the stems, I wanted to ask about the responsibility of the incoming system administrator.
"My friend" unofficially works as an administrator in a small firm. Most computers on Ubuntu, Win2k3Server + 1C - licenses. There are also several win-machines, some have a license and OOo as an office. But there are those that were inherited, i.e. maybe legally bought, or maybe delivered like that, well, the office from MS is similar.

And so a question what will be to the administrator such in case of check?
The admin signs for the salary, as I understand it, on internal forms (in the sense, for a report to management).

Once again, there is no official employment, but employees know who and what they do.

Thank you.

PS Everything happens in Russia.

I was in the same situation when I was 9 years old. OBEP covered the desk in which I installed Windows, office and 1C 2 years before, of course unlicensed. Gendir was taken by the balls and he decided to hand me over to the trash as an evil pirate.
The general director calls me and says that trouble is trouble, everything is broken, you need to install Windows and 1C, come urgently and take disks with software with you, they say help me out, I won’t offend with money. By that time, I forgot about this office, I lost my phone, and I didn’t immediately recognize who was calling, his expressive speech seemed suspicious to me and suggested a set-up, because the gender was a redneck and a passive homosexual in life. I said that I no longer work, hung up the call and added his number to the banlist.
The next day, garbage comes to me, they say come with us to the department. I ask on what issue, they answer me “do not bother with questions, they said go, then you must.” I said that I would not go anywhere, let them call with a summons, and closed the door under their noses. They knocked, rang, threatened to scrub the door, did not open it. Leaving stuck a summons on the door, another one came the next day by registered mail.
A day later, as it was said in the agenda, I come to the investigator. They immediately began to treat me that you, like, caused nifigovy damage, we will close you for 9 years, they say you will sell the apartment to pay off, and other similar bullshit. Next to the sledak was a representative of 1C (or maybe not a representative, but just horseradish from the mountain, I didn’t ask him for documents) who offered to pay 300k and disperse with the world. The investigator pressed that 5 people had testified against me, gave me an explanatory note from the CEO in which he blamed everything on me, let me read a statement from the CEO that I stole the money he had given out for licensed software and put a pirate instead (in fact, there was no money ). The statement was supposedly attached to my receipt of money, printed on a printer and signed by whoever, but it seems.
In response to all this, I testified that for the first time I heard about an unlicensed from them, I didn’t install any software, but only repaired the printer (because I know that my signature was on the order form for consumables for the printer, there was nowhere else to redraw it on a receipt). Then they raped my brain for another 2 hours, threatened to immediately close me in a pre-trial detention center, threatened to send me to a cell “especially for such smart ones” in the department, threatened to muzzle my relatives and much more. To everything I answered that I didn’t know anything, I didn’t know anything about anything, except for what has already been said, I have nothing to add and I won’t negotiate with anyone. As a result, threatened and released.
Then the case languished for another six months, during this time I was called in for interrogations 4 times, which took place according to the same scenario, then everything somehow died out, the case was never opened.
Z.Y. I then fully paid off with the CEO, but this is another story that is still too early to tell, the statute of limitations has not passed.

First of all, I would take and check the licensing of those Vidn that are on the mentioned computers.
Then a servant to the authorities that they say. On such computers there are unlicensed programs. I recommend changing/licensing them. Estimated cost XXXdol. An alternative solution is to change to an open OS. BUT then Program 1,2,3 will stop working. And it will take N man/hours.
And then let the authorities figure it out

If there’s no way without a pirate, I would do it as follows, take down the non-face Windows, set the clock in the BIOS a year ago, put everything you need, then set the clock as it should, give it to the user. True, I'm not sure that Windows will be able to activate incorrectly over time.
I ask you not to downvote much, because I think that the administrator is not to blame for the fact that our states protect the rights of foreign companies.

If he does not "split" then nothing will happen. The fact is that the investigation is obliged to prove that a particular person installed unlicensed software to attract an admin.
As far as I remember, computers with non-licensed software have the right to confiscate and destroy, as well as expose the organization to damages for using non-licensed software, but it is almost impossible to prove who exactly installed the software. Therefore, in practice, only those who are involved are:
1. "Broken" and signed a confession.
2. Caught on a “test purchase”.
3. Caught red-handed (in case of using special software, including botnet control programs).
In other cases, the investigation, as a rule, lowers the case "on the brakes" because. nothing to go to court. The distributions from which the “pirate” is installed are replicated in quantities of over_9000, which means that even if you prove that a pirated assembly *** is installed here and the suspect has the same assembly, then a screenshot of the tracker with the number of distributions will lead the investigation into a stupor. For the suspects become a little more than 100,500 ...

If the employees point out to him that he did not install everything licensed, then it will be bo-bo for him.

The policy of developers of MS type software is aimed at punishing the one who installed unlicensed software, they are not interested in the installation customer.

Yes, nothing will happen. Pointing to an incoming administrator with whom there is no employment contract (or other official ties) - get yourself a bunch of violations of the Code of Administrative Offenses.
The comrade does not bear any responsibility (unless it is proved that he made his way to the office under the cover of night and put scrap everywhere), the general director alone bears.
In short, except for the hassle, in the case of impenetrable stupidity of the gender, it does not threaten anything.
Word against word: the admin says to know I don’t know I don’t know what was there, I just installed the mouse driver; the general director can’t say know I don’t know know I don’t know, there is no unit in the staff list - he must know, know and understand.

It is better to transfer to ubuntu.
Do not sign any papers in which it is written that the software is illegal. No service, no contracts, nothing. Better yet, don't sign any papers with them at all.
On the form on which you sign for your salary - let it be written something in the spirit of "preventive work with hardware and / or user support." You can write about the server.
Well, it’s better to keep 30-50 thousand with you (if we are talking about Russia).
In general, if they come for illegal software, there is no interest in catching the admin. This is simply unprofitable and uninteresting. Well, except that you will fall under the implementation of the plan to catch "installers". Jur. it’s much more interesting to press a face with this and the admin will most likely be offered “cooperation” in the spirit of “write a piece of paper that you didn’t install or touch any unlicensed software (and taking into account the presence of ubunta, it was quite possible to deal only with it) , and there we ourselves somehow.
Well, yes - never carry with you any disks / flash drives with cracks / distributions / iso-shki. And delete all this to hell from a personal laptop.
