Law in IT

Is there a term for "implicit user data extraction"?

We all know that there are situations when various programs implicitly receive user data and send it to their server. This is not at all about various kinds of spyware, but about completely legal ones - browsers, games, antiviruses.
For example, this situation - you launch an Android application that will show you all the nearest cafes within a kilometer radius, but for this you must give the application access to gps and transfer your coordinate, the application will do what is generalized, but at the same time send your coordinate to itself on server for collecting statistics about the geography of users. Thus, by offering you useful information, the developers themselves received something from you. We assume that the law is observed in this case, since the user has given permission to collect data for statistics.
Does this process - implicitly extracting user data - have some popular science name? Like, for example, Data mining or social engineering (I want to note right away that these areas are not quite the same. Since the first involves data analysis, and not their extraction, and the second, as a rule, is a targeted attack on a specific target, moreover, pursuing illegal intent in the theft of important information). Are there related articles and publications? Do you know people who have researched this issue?

This is theft. If the program does not inform about it and does not give the opportunity to refuse.
