FZ-152 compliance request
Gentlemen, can the client of the service / organization (the nature of the services provided - hosting) that collects, processes and stores personal data (name, phone number, passport details, address) request from this organization documents confirming the eligibility of these actions, issued by the FSTEC (because they?)?
If the client is eligible, what regulations should be followed when requiring the provision of such documents?
If the documents are not provided, where can I write a complaint?
Added a support answer to the question on what basis they collect data:
"
We work with personal data in accordance with communications laws, they allow telecom operators with the appropriate license to process data without building appropriate data processing systems in accordance with the latest “fashionable” standards, in fact, as they have done all the time.
The same laws and regulations even oblige us to store and process this data, to provide it to the authorities upon request, and so on.
You can find the exact wording in the legislative framework yourself.

If you are an individual, you have the right to ask the operator:
- whether he processes your personal data
- the right to get acquainted with them.
Reason: 152-FZ, Article 20, deadline - 10 working days:
1. The operator is obliged, in the manner prescribed by Article 14 of this Federal Law, to inform the subject of personal data or his legal representative information about the availability of personal data relating to the relevant subject of personal data , as well as provide an opportunity to get acquainted with themat the request of the subject of personal data or his legal representative, or within ten working days from the date of receipt of the request of the subject of personal data or his legal representative.
If you were denied this, you have the right to apply to RosKomNadzor (not FSTEC) with a corresponding complaint.
You cannot contact FSTEC directly. They deal only with technical protection issues.
FSTEC does not issue any documents on the eligibility of processing. According to the law, the operator (with the exception of a wide range of exceptions) is obliged to register with RosKomNadzor and nothing more. On the RosKomNadzor website, by the name or TIN of the organization, you can find out if it has registered. But believe me, there are really a lot of exceptions to the registration requirements, and lawyers successfully sum up one or the other.
