Does the LiveJournal API have a TOS?

I'm looking and looking and I can't even find a link to TOS from the Livejournal API anywhere. And hence 2 questions:
1) is it (TOS) in general in nature?
2) what rights and obligations apply to developers who use the API without a TOS?
