Working on Upwork as a self-employed person. Real or not?
So, the law on the self-employed came into force in 2019. I would like to once again discuss the case of working on upwork in the self-employed mode without opening an individual entrepreneur.
The proposed algorithm of actions is as follows:
- Registration in the "My tax" application.
- Opening (or using an existing) foreign currency bank account to receive payments from Upwork.
- Once a month, the payment goes to the bank account. We take the course on the date of receipt of the payment, calculate the amount in rubles and generate a check in the My Tax application.
- If the bank requires an agreement for the purpose of currency control, then we provide a public offer of an upwork.
As far as I understand, it is optimal to specify Upwork itself as the recipient of the generated check. But the check also needs to include an email address. It is clear that specifying the email of the upwork is not very convenient, so as not to send them spam that they do not need. :)
Has anyone practically tried to work according to such a scheme? In whose name did the check end up being issued?
Are there any pitfalls when working as a self-employed person?

I haven't read the law myself. But on Habré I came across the following article, where this issue is discussed: https://habr.com/ru/post/431588/
And in the comments, people came to the conclusion that there seem to be no restrictions on foreign customers:
The last time I read the laws on employment, there were restrictions on the area of work and it was impossible to work abroad, has this changed?

yes, everything is exactly like that, you mark and pay tax for each receipt through the application, the familiar year works almost like this for upwork (pays 4%, like a physicist) - there are no problems, the tax office does not wool anyone, there for a couple of years they promised not to do any checks at all NPD-kam.
But if you work for a private person on upwork, then you need to decide: either make payments as services to a physicist and then 4% taxes, but for the tax in the future you may have to prove that the client is a private person, because. they can only see that the money comes from Upwork, and for them this is a legal entity of course.
Well, either pay 6% and provide services to the legal entity out of harm's way, no matter who the end customer is.
In short, work without problems
