Will they put me in jail for copying someone else's image?

Hello! I found an image
on one site
Now I want my startup to have such a logo
And moreover, the logo will be officially registered
The problem is that on that site you cannot buy an image and use it as a logo (subject to official registration as a trademark) The
question is the following
Will is it legal if I sit down and draw the same image myself, just by looking at the original?
Will the copyright be mine?

Everyone wrote to the best of their knowledge, but in general, everything is nonsense.
If you want to protect yourself as much as possible - try to find the author of the image and ask him for permission to use it.
Further. About the prison and some screenshots - nonsense. Only the author can file a claim for infringement and prove that the image belongs to him. Such things have nothing to do with prison and criminal law.

Well, it's unlikely they'll put you in jail. And even more so, if you yourself draw, then you can change a lot of things. Accordingly, this is already your image, just an idea taken from the Internet. Another thing is, if you take exactly that image, then they can sue you.

And you can link in more detail, otherwise I'm writing a letter to the judicial authorities, and there specifics are needed .. And give your first and last name, address of registration .. and preferably passport data.

The page on which the image is posted must be notarized.
Otherwise, the courts of the Russian Federation will not prove anything.
