What is considered plagiarism in games?

If I write a copy of an existing game (let's say Angry Birds), but with my own design and some new features, will this be considered plagiarism in court?

Mostly characters. the script is the easiest to change beyond recognition,
and the characters, both in animation and in games, are easier to register and defend their copyrights on them, meanwhile they are stolen more often.
