What about copyrighting a design if you made your own and it looks like another?

Let's say he came up with and drew a design, and it (accidentally!) turned out to be similar to the design of Vasily Pupkin, which he has been selling via the Internet for six months. Let's also assume that the degree of similarity is not 100 percent, but 80-90 - similar effects, markup, the very general appearance of the design is such that they can be put side by side. How to prove that you invented and drew it yourself, and can there be a punishment for what you invented if it coincides with any other design?

There is no corpus delicti, and therefore no punishment. I advise you not to fill your head with hypothetical incidents, eat delicious French buns, and drink tea.
