Refusal to return goods by Ulmart with the status of "fur damage" is it legal?

Essence of the question: I bought a video card in Yulmart with the status of mechanical damage, lack of elements (yes, I wanted something strange). The photo of the product clearly showed: one capacitor was torn out on the pci-e connector with meat. Decided to pick up and try to do. However, an acquaintance, to whom I took her when she called, explained that it was not a capacitor, but a GPU burner. In general, 3 days after the purchase, I came to Yulmart to return it. And then a surprise: they explained to me in the service department that goods with the status of inoperable are not accepted back by moneyback even within 7 days. They sell it as non-refundable parts. If anything - order #0032899805. Actually my question is this: is it legal to refuse a return from walmart in such a situation? The purchase was made on 03/27/2016, tried to return 03/30/2016

that the point here is not in the capacitor, but in the GPU burners.

And if it was you who burned the GPU and are now trying to deceive Walmart? No need to look up. Against (and for) such greedy bores as you write 10-page conditions and rules for returning goods.

If somewhere in the rules on the site it was written that goods of this category are not subject to return and exchange, then most likely it is considered that you have agreed with the rules. Because in this way, the store gets rid of illiquid assets at reduced prices, and this is a payment for savings, because. in this condition, the warranty will not be accepted from them.

Eh, Yulmart.Discount, how many memories... Once in 2014, I wrote a bot for one office, which was supposed to intercept "hot" positions exhibited at inadequately low prices. The bot conducts a quick assessment on Yandex.Market ("hot" options happen, only for those positions that are no longer in their own assortment at the time of the markdown, for those positions that are still traded, they never make mistakes with prices) and multiplies by a coefficient , calculated from the declared state of the goods.
So, in the first two days of its combat use, more than ten operations occurred (and this is only in one product category! However, it was the end of December). I have never seen such "hot" positions when hand surfing, I suspected that these were fairy tales. I turned off the bot when small orders were placed for about 35k rubles. to different accounts. One colleague went to pick up all this, returned with nothing - not a single one of all orders was delivered! (all orders in the personal account are up to date, the date of receipt is a number). The only thing that the manager could tell him was that it happens very rarely, when two applications arrive at the same time, then both can be booked before the balance is written off (it seems that these Indians have not heard about atomic transactions), and logistics performs the one which timestamp is slightly earlier.
I thought: my bot checks for updates once a minute and immediately places an order as soon as it finds a suitable option, but out of more than ten orders, it didn’t get a single one, everything was taken from it from under its nose, which means that someone is parsing and booking faster than him, much faster! Who could it be? Just someone else's bot! It seems that at that time someone had already built their own business on this. We are late.
Since then, I have not dealt with Ulmart. Discount, I have no idea how things are going there now.

Can't be returned. If you take a new product in walmart, then everything is fine with a guarantee. If you take it at a discount (repaired or faulty), then you buy it "as is".
A similar scheme of work in Auchan.
