In legal terms, I'm afraid you can hardly prove that the data were there without evidence of their presence. Is it possible to click on violations of the work of the SC itself (this will only work if they are lazy, but not if the data is really kirdyk).
Practical moment: take an interest in what means they used and in what sequence. Further, the easiest option is to remove the image and contact a data recovery office. Or with your own hands - for starters, you need to determine what has come up in the disk. Data from pancakes is saved with the help of software, and the controller, for example, used to be well rearranged from another dead man of the same model.
