How to explain this behavior of bash, in case of init.d/openvpn start?

/etc/init.d/openvpn start- fail, in /var/log/message errors on the lack of rights to log files.
OpenVPN starts from nobody.
I played with the rights to dirs and files - it does not help.
If you run it as
/bin/sh /etc/init.d/openvpn start
it is, everything is fine.
It is important to fix the launch without specifying an interpreter, because service auto start not working.
