How legal is a site without TOS in the .net domain?

Hey!
I found a site that accepts payments through payment aggregators (free-kassa.ru).
But there are no user agreements on the site, no Term Of Service (TOS).
1. And here's the question: how does this threaten this site?
2. How legal is its activity?
3. Who can hold him liable for fraudulent activities (if any), given that the domain is in the .net (or .com) zone?
4. Is this activity legal in Russia?
