Formatting from spyware doesn't help?

I want to remove spyware.
Already did the formatting.
Full formatting from BIOS did not help.
Probably the spy is in the BIOS firmware (motherboard) or HDD.
Do I think correctly or not, or are there still ways where you can install a surveillance program?

Boot partition try clearing fdisk /mbr
BIOS can also be reflashed
How did you determine that there is spyware?
