Can I use someone else's trademark/name if it is not registered?

A local expensive magazine is printed in my city.
The journal has a unique title.
Having checked on the Rospatent service and in the trademark registration service for its registration, I found that this name was not registered.
The site has a magazine, in the footer of the site after the name there is a sign "C" and also the year 2000-2016.
That is: NAME_JOURNAL SINCE 2000-2016
There are no C, R, TM on the journal itself, neither in the title nor in the notes.
Certificate of Mass Media Registration PI No. ФС14-0763 dated 06/01/05 issued by the Office of the Federal Service for Supervision of Compliance with Legislation in the Sphere of Mass Communications and Protection of Cultural Heritage in the Far Eastern Federal District.
Questions:
1) Can I print my own magazine with the same title within the law?
2) Can I use the name of this magazine in the name of the application or program?
Could any sanctions be applied to me, up to filing an application with the court by the person who is the owner of that magazine in each of the above cases?
3) What if I register this name myself now and myself sue the owner of the magazine that has been published for a long time with this name? Or fail to prove it?
After all, the magazine has been published for a long time, but the name is not registered.
4) Могу ли я взять для своего названия своего произведения\журнала\программы\приложения производну часть слова от уже издаваемого названия (например, выпускается журнал ДОМ, а я назову ДОМОВОЙ. напомню, что ДОМ не зарегистрирован, но приводится везде как ДОМ С 2000-2016).

1. Так как уже зарегистрировано СМИ, то использовать тождественное название нельзя! Засудят
2. Можно зарегистрировать тождественный товарный знак по отношению к другим классам не связанным с СМИ, это в рамках закона
3. Роспатент проверяет названия перед тем как дать добро на регистрацию, тут шансов нет. Тем более что уже есть СМИ и введено в оборот.
4. Можно. Если использовать фентезийное написание то вообще без проблем
