Can a family domain be taken away?

The use of proper names in domains is fraught with a lawsuit, but so far we have only seen claims from corporations. Having registered a family domain name the other day, I wondered if slow-moving well-known namesakes could claim it?

If you have not registered your last name as a trademark (such as "Smirnov"), then they cannot. If they were able to register (and even illegally), then they can.

If the domain is registered before the trademark, will you still have to give the domain away?

On what grounds?
In my opinion, even corporations do not always sue, preferring to buy domains. And even more so you don’t have to worry about sluggish well-known namesakes ... They have no reason to. It's not a registered trademark...
