Why does the laptop turn off before the battery is completely discharged?

An HP laptop with openSUSE on board consistently kills batteries in 3-4 months. And not only does it start to work less, but it is stupidly cut down after less and less time off the network.
I tried to figure out what's going on:

# less /proc/acpi/battery/BAT0/info
present: yes
design capacity: 4436 mAh
last full capacity: 4436 mAh
battery technology: rechargeable
design voltage: 10800 mV
design capacity warning: 616 mAh
design capacity low: 418 mAh
cycle count: 0
capacity granularity 1: 198 mAh
capacity granularity 2: 3820 mAh
model number: MO06062
serial number: 16212
battery type: LION
OEM info: 13-12

those. The battery seems to be steadily charging up to passport values.
I look at the status immediately after a sharp shutdown:
# less /proc/acpi/battery/BAT0/state
present: yes
capacity state: ok
charging state: charging
present rate: 382 mA
remaining capacity: 4026 mAh
present voltage: 12580 mV

those. zero is still very far away.
What could it be and what can be done about it?

@juffinhalli

1) Boot into sysrescd
2) Speed up battery drain - burnP6
3) Watch the system - watch 'cat /proc/acpi/battery/BAT0/state'
The problem is probably only in hardware
