What should be the license of Windows 8 when developing for Windows Phone 8, taking into account the further promotion of the application in the MarketPlace? What happens if you create an application on a pirated version and then try to upload it to the market?

Must be regular Windows 8, Pro or Enterprise (development tools will not work on RT). For development under WP, there are no special requirements for Windows. To upload to the Windows Store, you must have a developer license + paid access to the store.
