What percentage of copied content from a design is copyright infringement?

Hello.
The situation is this. On one of the sites for the sale of digital content, a template came out that adopted a lot of elements from me and for a clean color scheme (our templates, by the way, are on the same topic, which, as it were, hints). But at the same time, he seasoned everything with his own style, which is a little distant from the original, added more pages and stuff like that - it seems there’s nothing to complain about, but as an author who worked on the original design for a long time, I can safely say that the stolen elements and the arrangement of blocks where something about 25%.
What percentage of the stolen should be in order for me to be able to report the theft of certain elements?
I have a strong feeling that the design must be stolen by almost 70% in order to be able to submit the DMCA form.
Communication with the author did not give anything.

To be able to send a DCMA denunciation, you need to be able to send it.
Once upon a time, pornographers snitched on developers of free software because of the coincidence of names - well, the robot wrote and sent denunciations, it does not distinguish program code from porn - so Google was excluded from the issuance only on the way.
