What determines whether a windows application will offer to use the TCP windows scale or not?

There is a problem. There is a certain device with ubuntu 12.04 on board, there is an emulator of this device under WIn, there is a service under Win that drags information from the device. Digging out the problem of slow downloading of information from the device, I got to the bottom of the fact that the service offers the emulator to scale TCP windows size, but the device does not. That is, the problem is at the level of the SYN request to establish a TCP connection. Where to dig next? The service is running under Win7 pro x64, under Win 2008 R2 standard the picture is similar. The service is written under .Net, the authors learned about TCP windows size from me.

Question removed. It seems to depend on the port, the real device is 80, the emulator is 8088. Now it allows scaling the window size everywhere, but this did not solve the problem. :(
