Is the license broken?

Hello!
I don’t know what the problem is, but QIP started to crash often, but that’s not the point :)
The fact is that when you take off, it offers to send a bug report. Many have seen it, and who has not, then:

Pay attention, highlighted in a red box madExcept 3.0 non-commercial edition.
And so in what, actually, a subject. Does the qip in this case violate the non-commercial use criteria or not?

author: does not violate. here is an excerpt from the license, the full text of which, in theory, could be read here , but I posted the text from the file that comes with the package on paste

FREEWARE PRODUCT(S)
— The packages "madBasic", "madKernel", "madShell" and "madSecurity" may be used
freely
for both non-commercial and commercial use, without buying a license,
provided that:
(1) The author Mathias Rauen is given proper credit for his work.
(2) The licensee does not claim that the library was written by him.
(3) If the software is modified, any software containing modifications must
apparently state in the modified product or documentation
(a) that it has been modified,
(b) the identity of the person or entity that made the modifications and
© the date the modifications were made.
(4) The mentioned packages must not be third transferred to any third party unless
such party receives a copy of this agreement and agrees to be bound
by all of its terms and conditions.

all points were satisfied.
And about the falls - refer to the forum in the bug section or send it to the soap. All bugs are considered and processed.

The program is proprietary software, probably yes, even if it is freeware.
But they will surely back off. In QIP, even the XMPP module is borrowed from Miranda (GPL), but the Miranda developers have made dual licensing for them.
