Is it legal to copy a TechMedia (Toaster) design?

So it goes.
I was looking for information on SVG, I came across this miracle
. I think - is it really a new project from TM?
It turned out not.
But the design is a complete copy, except for the flowers.
Slightly more than all publications from one user.

Gee. In my opinion, to suspect TM that they will not be able to draw a completely new design for a new project, but at the same time remain within their corporate identity, is strange. TM has quite qualified specialists and demanding bosses.

They pulled off Contact, they think that they will trample. And for 7 years now, nothing has been rushing.
It's all illegal, because it's straight 1 to 1.
But the owners of the rights to the original design will not even waste their time suing, because:
1. These guys are not competitors. And they never will.
2. There is nothing to take from them.
For example, the Russian-language overflow clone project was more original (they have now merged into overflow). Although they stole the idea, they made their own.
About the same as Toaster, he stole the idea from overflow, but did it his own way.
