How to purchase an unused domain legally?

There is a site for which you need to pick up a domain name. When requested, it shows that it is busy, although in reality if you go to this address, you will get an error that such an address does not exist and other blah blah blah.
So, is there any way to take away this domain from its current owner, if there is one, without paying a lot of money?

Buying a domain does not imply placing a website at this address and generally using the domain.
Moreover, some of the domains on http do not open for me at all. But mail and jabber work for them. Too lazy to make websites, but the domains are beautiful.

If you did not open the site by domain name, this does not mean at all that the domain is not used. Read about dns and all sorts of records ala A, NS, MX, etc.
