GPL v2 violation

So, the situation is as follows: a Chinese tablet Dropad A8X was bought, which is based on the reference design of Samsung SMDKC110 (S5PC110 Development Kit). There are no source codes anywhere.

Does this violate the terms of the license?

As far as I understand, you must send a request for the source code and in response you should be provided with it. And when they do not provide it to you, then it will be a violation.

if the project was forked, and their code was added under a closed license, there is no violation. it may look like a proprietary mod, plugin, or patch.

Mmm, I think it's like windmills, it's easier and less time consuming to fork the source codes that are now in the public domain.
