Do I have the right to sell the layout ordered on the side according to my PSD layout?

I make good PSD layouts. I wanted to sell them on Themeforest, but the demand for them is clearly lower than for html templates.
Question: if I order layout according to my PSD layout from a third-party freelancer, and then I sell it on Themeforest, will it be legal? Theoretically, I can correct the code.
Not a very ethical question, but still I would like to understand. Thank you.

You create graphic intellectual property. Layout is just one of the ways to display it. Moreover, you hire an employee for layout and pay for his work. The layout rights are transferred to you. There are of course special conditions, but they must be negotiated separately. Even if you move away from the design, and the site will have a backend, you still hire a programmer and pay for his work, and the result of the work (rights) belongs to the employer (you).

Determined by the contract between you and the contractor. If the contract contains a clause on the transfer of exclusive rights to layout, then you can do anything except change the authorship.

Of course, you have the right to sell, but purely ethically, it seems to me that this is not very beautiful. At a minimum, this point should be mentioned when ordering layout. As a maximum, it is worth finding a partner with whom to work constantly and share money honestly.
The code, like your layout, is a kind of intellectual product. If it is being sold in bulk, you probably would not be very pleased to know about it. And yes, I wanted to get something out of it. Leave your signature at the very least. For many studios, mandatory copyright is par for the course.

For a layout designer, there should be a TOR with a clear criterion - acceptance in themeforest, that is, layout + support before the template is accepted for sale. The price will depend on this. In addition, in a civilized world, the sale of someone's work must be negotiated in advance. For example, on the same themeforest, if you want to use the slider not on your site but in a bundle with a wordpress template, you need to buy an "extended developer license", it costs more, but allows you to sell the purchased component bundled with your template. That is, you must agree with the layout designer, but it is better to sign a piece of paper stating that he has no claims to sell the program code. It is important. Let not in the CIS countries, but it is important.
Another point, you will be asked to write documentation for the template, this will most likely have to be done by the layout designer. If you can accompany the program code with your documentation - very good, but then why don't you make up your own? The documentation should be expanded, the reviewer immediately opens the docks and looks at them whether it is worth moving on to the code, if there are docks and they are good, the second stage begins - checking the functionality, then a little code review. It's good if it is provided with comments, sometimes they ask for it separately.
