Copying a project under a clean one - what to do with thieves?

Hello habrauser.
I took an active part in the development of fprints.ru and the death of the old and tight forprints.ru. Both of these resources are projects of the Everything for the Printer company (you could see our story somewhere on Habré). The second site has just now reached the stage of development almost complete, before that it had been in constant updating for two years. All materials are copyrighted, paid for by internal or external copywriters.

And now to business.
bprints.ru . Design - for pure forprints.ru (with banners, buttons), which in ancient times was done by our artist Maxim Abrosimov from icolab.ru , he also painted fprints.

The developer of this case is kozlov-vadim.ru/Kozlov Vadim. Without looking back at the surname, I dare to assume that his life is not sweet, since he takes on such projects and does not hesitate to write copyrights.

Without tantrums and pulling out hair, I ask for advice. We have been copied before (competitors in this industry have no imagination at all), but never so brazenly.

What to do? Maybe write a statement to the prosecutor's office or go to Novgorod for a cup of latte to Kozlov? By the way, he is in touch with our tech. did not leave as a director.

As an option, write to the hoster of this site that their client has violated copyright law. If the hoster is sensible, perhaps they will help you. Or to the court, but this is an extreme measure and very costly.

And what do you want to achieve? Have you tried to assess the damage?
If you remove these sites, then you do not need to go to the developer. bprints have office coordinates. Go to them, put on someone responsible and talk about this topic. If they have a legal entity, send an official letter demanding they stop using your design. And then go to court for closure and compensation for damage (I don’t know how realistic it will be with our laws to achieve compensation there).

Have you ever sent yourself the source code of a design in a letter that you can present as evidence in court, in which case? If not, then to prove that your craft will be problematic, IMHO. I heard a story in which the designer was able to sue the bank for more than the customer once paid him. The mistake of the customer-studio, who sold this design to the bank, was that he did not draw up an agreement with the freelancer on the further use of this design and the transfer of rights in favor of the studio. The designer won the lawsuit, as a result of the fact that the source files were from a specific date (the date the envelope was sent is fixed in the mail) - earlier than the site was developed for this bank. Actually, such evidence is stored until a possible trial and printed out in the trial. :)

To get started, contact the owner of that store - at least find out his attitude to the problem, maybe this unfortunate developer sold him a stolen design as his own. Try to talk about the legal consequences for him, say that you propose to resolve the issue out of court instead of litigation, tell him how much the design and texts cost, and how much he must pay if he wants to continue using them. Give an example of existing court cases on this subject.
