Ability to use your cover of a song in a commercial game
Making a game, the question arose about the soundtrack.
By commercial game I mean a game that will be sold for money in the AppStore.
What problems can arise (in Russia and / or Europe and / or the USA) if a cover of a famous copyrighted song is recorded specifically for the game (instrumentally or synthesized, or is it important how?) And this cover version is used as a soundtrack for the game ? Would this be considered copyright infringement? There are examples in the AppStore\Android Market of games that use their own versions of famous compositions without paying a penny to copyists, who owns the rights to these compositions? There will be commercial success - agree with the author and unfasten the percentage. It won't - and don't worry. I always do this. In the sense that I do not bother. Composers, like programmers, are happy when their talent is recognized.
I'm far from an expert on this, but the essence of the law is that the copyright owner disposes of the work as he wishes, therefore if he did not allow you to use the work in any form, it cannot be used in any way.

In general, it turns out that in order to create a cover, it is necessary to conclude an agreement with the company (or representatives of this company, if it is foreign), which owns the copyright for the song, or directly with the author (if he has not transferred the company the right to rework).
